We operate the website that connects users (travellers) and professional/experienced independent tour guides. Our platform allows tour guides to create their profile and advertise their services for tourists. We do not publish, create, sell, control, offer, deliver, or supply any guided tour. When you make a booking, you are entering into a contract directly with a tour guide. In no event shall TourGuideCorner.com be deemed a party to any agreement whereby you book a guided tour from a tour guide. Tour guides are responsible for information and services they advertise.

Acceptance of Terms and Conditions

When You access the Site and/or use our Services, You hereby represent and warrant that:

- You have read, understand, and agree to comply with and be bound by these Terms and Conditions;
- You are an individual at least 18 years old or a duly organized, validly existing business, organization or other legal entity in good standing under the laws of the country in which You are established;
- You are not forbidden by TourGuideCorner.com to access the Site.

If You do not agree to be bound by these Terms and Conditions, You may not access and/or use the Site and/or our Services and should immediately leave the Site.

These Terms and Conditions should be read together with the Cancellation Policy and Privacy Policy, as they are incorporated by reference into these Terms and Conditions.

TourGuideCorner.com platform

The Website TourGuideCorner.com serves as an online advertising platform through which Professional and Experienced Tour Guides around the world may create their profiles. This will allow tourist to find services in requested destination with relevant knowledge. Traveller(s) can learn about services provided by Tour Guides and communicate with them directly via mode provided (email, mobile phone or social media platforms)

Tour Guides who create profiles understand and agree they provide voluntary contact and other information. Tour Guides act exclusively on their own or their company's behalf for their benefit and not on behalf of or for the benefit of the TourGuideCorner.com.

TourGuideCorner.com is not involved in any booking process and does not guarantee including but not limited to, the quality, safety, legality, truth or accuracy, of the Tours and services as well as the ability and availability of the Tour Guides. TourGuideCorner.com also does not guarantee the conduct of Travellers during Tours and ability of Travellers to pay for their selected Services. The company is not responsible for determining whether any services and/or activities listed on the Website are in compliance with any and all laws, orders, statutes, ordinances, rules and regulations of federal, state, county and municipal authorities.

Users/Registered Tour Guides agree not to do anything to create a false impression that you are endorsed by, partnering with, or acting on behalf of or for the benefit of the TourGuideCorner.com. Users understand and agree that the TourGuideCorner.com is not a party to any agreement entered into between Tour Guides and Travellers, nor is the Company an agent or insurer. The Company has no control over the conduct of the Users on the Website and disclaims any liability in this regard to the maximum extent permitted by law.

Notwithstanding the foregoing, the Company responsibilities are limited to facilitating the availability of the Services on the Website, which includes:

To provide a ready platform for Tour Guides to register, create their profiles and information about services provided

To provide a ready platform for visitors to view Tour Guides profiles and their contact details with services/guiding tours offered.

To act as moderator for standard and control, pre-empt problems and other purposes. The Company reserves the right, but has no obligation, to monitor disputes between Users and take appropriate action if the Company, in its sole discretion, finds any violation of the Terms or other improper conduct.

To integrate an established payment gateway (e.g. Stripe) to accept annual membership fee from Tour Guides for access to the platform and possibility to advertise their services.

To source for, market and promote Services on the Website.

To maintain and provide online support and customer service to the use of the Website.

Content

Users are solely responsible for their Tour Guide profiles/accounts and all content and information submitted. Users warrant and agree to maintain the accuracy and originality of such content and information and that the content or information or photos do not infringe and violate any privacy rights, copyrights, trademarks, IP rights. Users automatically grant the TourGuideCorner.com irrevocable, worldwide, unrestricted and royalty-free rights and fully paid-up license to use, copy, license, sublicense (through multiple tiers), adapt, distribute, display, reproduce, transmit, modify, edit the content, information and photos uploaded for the Company's activities and purposes, including but not limited to advertisement, third party business providers, marketing and promotions.

Under no circumstances will the Company be liable in any way for the use of any content or materials submitted by Users, including, but not limited to, privacy rights, copyrights, trademarks, IP rights, any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any such content.

The Company may edit the descriptive content of your information submitted, including but not limited to description, photos, highlights, and/or what is included. The changes are part of the value-added marketing services. The changes will be made available to the public. The Company is not responsible for any claims resultant from the changes made.

Currency

Tour Guides are able to pay their Membership Fee in three currencies: EUR, GBP and USD.

Prices

TourGuideCorner.com is free for Travellers looking for Tour Guides around the world.

TourGuideCorner.com charges Local Tour Guides annual membership fees for access to the website. We reserve the right to change prices however it won’t affect current paid annual membership fee.

TourGuideCorner.com can provide initial trial period for Tour Guides without any charges. Currently there is 3 months free usage and credit card will be charged only after the trial period.

Cancellation

Tour Guides have right to cancel their annual subscription and remove their profile from the website. The membership fee already paid is however not refundable. The payment for following year won’t be processed.

No Refund Policy

TourGuideCorner.com will not refund for annual membership fee already paid.

Copyright, IP and Trademark

The Website and all text, images, marks, logos and other content contained herein, including, without limitation, the tourguidecorner.com logo and all designs, text, graphics, pictures, information, data, software and program (Collectively "Content") are the proprietary property of the Company.

The Website content, look and feel of the Website may not be copied, imitated or used, in whole or in part, without the prior written permission of the Company.

Prohibited Use

The Website may not be used to recruit, solicit, or contact Tour Guides for activities not related with services offered.

Banned Users

Users agree to use the Services on the Website in accordance with the terms and conditions of the Website. If there are sufficient reasons to believe of any misuse of the Website and its' Services provided, the Company reserves the right to ban Users from the Website.

Limitation of Liability

Under no circumstances will the Company be liable to Users for any loss of profits, indirect, incidental, consequential, special or punitive damages arising from guiding services and Tours.

Warranties

Users (Tour Guides and Travellers) expressly agree that the use of the Website is at User's sole risk. The Company does not warrant that the Website will be uninterrupted or error-free or the results, that may be obtained from the Website basis without warranties of any kind, expressed or implied.

Law

Any and all services and rights of use hereunder are performed, performable and/or sold in the European Union. Any dispute between Users and the Company will be governed by the laws of the Republic of Poland.

Modification

We reserve our right, at our sole discretion, to make any changes to the Terms. Any modifications will be effective immediately upon posting on the Website. Your continued use of the Website will constitute your acceptance of such changes or modifications. You should review the Terms and its incorporated policies and guidelines from time to time. If you do not agree to any amended terms, you must stop using the Website.

Privacy

We respect the privacy of information submitted to us. Please refer to the Company's Privacy Policy, which forms part of the Terms of this document.
